Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Patrakar Nagar P.S. Case No. 469 of 2022 registered for the offence under Section 395 of the Indian Penal Code. The prosecution story in short is that on 09.08.2022 at about 1PM, 3 miscreants came to the house of the informant and thereafter 2 more persons came and the accused persons took Rs. 50,000/- cash from the almirah, golden chain from the neck of the informant and 210 gms silver from Almirah and 10,000/- cash from her daughter in law and 3 mobile phones.

Patna High Court CR. MISC. No.20600 of 2023(2) dt.22-05-2023 2/3 Learned counsel for the petitioner submits that the petitioner is in custody since 16.08.2022 and the petitioner has committed no offence and has falsely been implicated in this case.

Learned A.P.P. has vehemently opposed the prayer for bail of the petitioner and has submitted that the petitioner has 2 antecedents.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Magistrate 1st Class at Patna/concerned Court below in connection with Patrakar Nagar P.S. Case No. 469 of 2022. The Court below is directed to transfer all the cases in which the petitioner has been made accused in one Court and the Court below is directed to conclude the trial expeditiously. The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on their absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court

The petitioner will mark his attendance in Alamganj Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
