Petitioner is in custody in connection with Obra P.S. Case No. 49 of 2016 registered under section 304(B)/34 of the Indian Penal Code.
Allegation in brief is that son-in-law of the informant telephonically informed him about the death of his daughter and when he went in that village, he learnt that the in-laws of the deceased had killed her.
Submission is that she died natural death and the information of death was given by the son of this petitioner to his father-in-law and this petitioner is father-in-law of the deceased. Postmortem report does not show any external injury. No opinion
Patna High Court Cr.Misc. No.52114 of 2016 (5) dt.01-03-2017 regarding cause of death is given but the doctor conducting the postmortem examination kept the opinion pending till receipt of the report of viscera and the viscera report has been received which reveals that no any kind of poison was detected in the contents sent for examination.
Having considering the said facts and circumstances, the petitioner, namely, Janeshwar Ram is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad (Bihar) in connection with Obra P.S. Case No. 49 of 2016.
