JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 341, 323, 283, 332, 333, 307, 353, 427, 152 and 504 of the Indian Penal Code.

Petitioner is named in the FIR and allegation against him is of blocking the road and also creating obstruction to the public.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that there is no specific allegation against the petitioner and other similarly situated accused persons have been granted anticipatory bail vide orders dated 13.06.2016 and 25.06.2016 passed in Cr. Misc. no.24580 of 2016 and Cr. Misc. no. 23559 of 2016

Patna High Court Cr.Misc. No.19388 of 2017 (3) dt.11-05-2017 2/2 respectively.

Heard learned A.P.P. also.

Having heard both sides and in view of the allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

However, petitioner may surrender in the court below at Patna in connection with Dulhin Bazar P. S. Case no. 204 of 2015 and make prayer for regular bail which will be considered and disposed of, if possible on the same day, on the fact that no specific allegation is there against the petitioner as well as other co-accused have been granted anticipatory bail by this Court without being prejudiced by the order of this Court.
