The petitioner seeks bail in Raghopur P.S. Case No. 36/2017, instituted for offences under Section(s) 302, 201 and 120B/34 of the Indian Penal Code.
Petitioner is husband of deceased.
It is alleged in the written report that sister of informant was married with this petitioner. His sister has been murdered in her Sasural and her dead body has been disposed off without any information to her family members. Case diary has been received.
Learned Addl. P.P. after looking into case diary has submitted that deceased was issueless. Petitioner wanted to solemnize second marriage. For the aforesaid reason,
Patna High Court CR. MISC. No.18782 of 2019(5) dt.30-05-2019 2/2 occurrence has taken place and dead body of the deceased has been disposed off.
From the written report, it appears that dead body of deceased was disposed off without giving information to her family members.
Therefore, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected. The trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within nine months.
The petitioner will be at liberty to renew prayer for bail in the event trial is not concluded within aforesaid period. (Sanjay Priya, J) rakhi/- U T
