2. The appellant, who is a holder of arms licence and the arms against such licence, is aggrieved by the order passed by the District Magistrate, Saharsa cancelling his licence and the order affirming such cancellation by the Commissioner.

3. The learned Single Judge also, taking into account that the appellant was made accused in a criminal case with the allegation of opening fire, rejected the claim of the appellant that his licence be restored.

4. However, the learned Single Judge indulgently gave the liberty to the appellant to approach the District Magistrate again after the trial is concluded and he is found to be innocent.

5. There is no reason why the aforenoted order of the learned Single Judge be interfered with.

6. The appeal stands dismissed.
