JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sour Bazar (Patarghat O.P.) P.S. Case No. 448 of 2016 instituted for the offence under Sections 366A and 34 of the Indian Penal Code. It is alleged in the written report that wife of the informant has been kidnapped by the petitioner along with his friends. The statement of the victim girl was recorded under Section 164 Cr. P.C. and annexed as Annexure-2 wherein she has specifically stated that she has not been kidnapped by the petitioner. She has in fact levelled allegation against her husband of forcing her to commit illegal act. The girl has stated her age to be 19 years but the court has assessed her age as 17 years. Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.14954 of 2017 (2) dt.30-03-2017 2/2 prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 448 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
