JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 4.10.2016, in connection with C2/293/16, registered for offences punishable under Sections 30(a) and 47 of Bihar Excise Amendment Act. Allegation is of recovery of 28 litres of Nepali liquor from the petitioner.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner rather the same recovered from the Auto-rickshaw and he has been in judicial custody since 04.10.2016 without having any criminal antecedent.

No.53836 of 2016 (2) dt.15-12-2016 2/2 Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate -Sitamarhi, in connection with C2/293/16.
