Petitioner seeks bail in Vaishali (Belsar OP) P.S. Case No.212 of 2018 instituted for the offence under Section(s) 457, 380, 414/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedents. There is no recovery from his conscious possession. He has been named as accused only due to enmity. Seizure list is part of the First Information Report from which it appears that one Apache motorcycle and rupees seventeen thousand was recovered from possession of the accused persons. The seizure list does not bear the signature of the petitioner. Petitioner is in custody since 10.08.2018.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.66647 of 2018(2) dt.19-11-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali, in connection with Vaishali P.S. Case No.212 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
