The petitioner, who claims to be a person of clean antecedent and is in custody since 07.02.2020, seeks bail in connection with Special Excise Case No. 76 of 2020, arising out of Purnea Sadar P.S. Case No. 60 of 2020 dated 07.02.2020 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the prosecution report, it appears that a truck was intercepted from where 3095.250 litres of foreign liquor was recovered. The petitioner was driving the vehicle who wanted to make good his escape but

Patna High Court CR. MISC. No.19243 of 2020(2) dt.08-06-2020 2/2 was arrested.

It has been submitted that the petitioner did not have any idea that the consignment which was booked in his truck contained liquor.

Considering the nature of accusation against the petitioner and his period of custody, he is is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge (Excise), Purnea in connection with Special Excise Case No. 76 of 2020, arising out of Purnea Sadar P.S. Case No. 60 of 2020.
