JUSTICE PRABHAT KUMAR JHA ORAL ORDER 22-05-2017 Heard the learned counsel for the petitioner. Notice was issued to complainant/ opposite party No.2 but today nobody appears on behalf of the complainant.

The petitioner apprehends his arrest in Complaint case No. 3326C/ 2015 for the offences allegedly committed by the petitioner under Section 307, 498(A) and other Sections of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The petitioner is husband and he is ready to keep his wife.

Considering the willingness of the petitioner to keep his wife, the above named petitioner is directed to surrender in the

Patna High Court Cr.Misc. No.4527 of 2017 (3) dt.22-05-2017 2/2 court below within four weeks from today and the court below on such shall grant provisional bail to the petitioner for six months on furnishing bail of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Subdivisional Judicial Magistrate, Begusarai in Complaint Case No. 3326 C of 2015.

The court below shall make all efforts for reconciliation of the dispute between the husband and the wife. If the dispute is resolved amicably between the parties, the provisional bail granted to the petitioner shall be confirmed. In case the dispute is not resolved, the court below shall pass orders on the prayer for provisional bail of the petitioner on its own merit immediately after six months in accordance with law.
