JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22.11.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 30(a) and 36 of the Bihar Prohibition & Excise Act. No doubt, petitioner carries criminal antecedent of similar nature which is evident from para 3 of the petition but taking note of this fact that nothing was recovered from conscious possession of the petitioner nor the petitioner was found sitting in the tempo from which alleged recovery of liquor is said to have been made.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl.
