JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Pasraha P.S. Case No. 119 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 25.02.2020. He further submits that in the instant case total 153.75 litres of foreign liquor was seized from a Pick-up Van. He further submits that the Driver and the Khalasi of the Pick-up Van were fled away. The petitioner was not apprehended at the spot and he was made accused in this case because he is the owner of the vehicle.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on his personal bond to the satisfaction of Additional

Case No. 119 of 2019, due to the circumstance of total lock down on account of pandemic Covid19, subject to the condition that the vehicle should not be used for carrying liquor in future.
