The petitioner seeks bail in Samastipur Rail P.S.Case No.153/18 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Allegation is of recovery of 35.750 litres of foreign liquor kept in plastic sack beneath the seat. Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession of the petitioner and he is in custody for four months having no criminal antecedent.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, be
Patna High Court Cr.Misc. No.67735 of 2018(2) dt.29-11-2018 2/2 released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-6th -cum-Special Judge Excise, Samastipur, in Samastipur Rail P.S.Case No.153/18 subject to the condition that bailors of the petitioner shall be of local having sufficient immovable properties.
