NILU AGRAWAL ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner, learned counsel for the Bihar State Food and Civil Supplies Corporation Ltd. and the learned A.P.P. for the State.

This modification application has been preferred for modification of the order dated 08.09.2016 passed in Cr. Misc. No. 34965 of 2016 by which petitioner was granted anticipatory bail in connection with Noorsarai P.S. Case No. 125 of 2016 pending in the Court of learned Sub-Divisional Judicial Magistrate, Nalanda on the undertaking that he will deposit Rs. 20 lacs within six months from 08.09.2016.

Learned counsel for the petitioner submits that he has already deposited Rs. 15 lacs in pursuance to the order passed in the writ application and he is ready to deposit the difference of

Patna High Court Cr.Misc. No.12280 of 2017 (3) dt.29-03-2017 2/2 the alleged defalcated amount only to the tune of 20%, which was not the intent of the order passed by this Court while granting bail to the petitioner.

However, learned counsel for the petitioner prays that he is ready to deposit Rs. 20 lacs for which further extension of four months' time may be given.

Prayer is allowed.

Petitioner is directed to deposit Rs. 20 lacs within a period of four months from today.

Order dated 08.09.2016 passed in Cr. Misc. No. 34965 of 2016 is modified to the extent indicated above. This modification application is, accordingly, disposed of.
