JUSTICE SATYAVRAT VERMA ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 323, 504, 498(A) of the Indian Penal Code.
The petitioner and the informant are present in compliance of the order dated 22.06.2023.
The learned counsel for the petitioner submits that petitioner and the informant are living together for the last six months peacefully.
Patna High Court CR. MISC. No.21202 of 2022(5) dt.27-06-2023 2/3 The learned counsel for the informant submits that though the petitioner and the informant are living together, but then, petitioner is not taking good-care of the informant and the child.
The learned counsel for the petitioner rebuts the submission of the learned counsel for the informant and submits that child has been admitted in a Government School. The learned counsel for the petitioner next submits that on instruction that petitioner will also get the bank account of the informant opened and in that account, every month, he will be depositing Rs.15,000/- from his salary to her account, so that the informant also does not have scarcity of money and will also ensure the well-being of the informant and the child. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Munger in connection with Complaint Case No.878(c) of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

However, in the event, if the petitioner for any reason does not deposit the amount as agreed in the bank account of the informant for two consecutive months, the informant shall be at liberty to file an application seeking cancellation of bail of the petitioner.
