Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks regular bail in connection with Surajgarha P. S. Case No. 16 of 2023 registered for the offence punishable under Sections 30(a), 32 (3) of the Bihar Prohibition and Excise Act and Section 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the there is recovery of 42 litres of illicit Deshi Chulai liquor and also the petitioner is in custody since 16.01.2023. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.21037 of 2023(2) dt.22-05-2023 2/2 the petitioner and his period of custody, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge- IV, Lakhisarai in connection with Surajgarha P.
