JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks bail in connection with Hajipur Town P.S.Case No. 834 of 2016 registered under Sections 328,376,385, 504 and 506/34 of the Indian penal Code and 66(E) of the Information and Technology Act.

This is the second attempt for bail by the petitioner, as earlier his prayer for bail was rejected vide order dated 11.04.2018 passed in Cr. Misc. No. 20210 of 2017 and allegation against the petitioner is of providing cold drink to the prosecutrix. After taking the drink she became unconscious and found herself in a room. Thereafter petitioner started blackmailing her on the basis of her photograph. Submission of learned counsel for the petitioner is that petitioner is in custody for two years and up till now out of 11 witnesses, only 08 witness have been examined.

Having heard both sides and in the facts and circumstances, as the trial is going on, I am not inclined to grant bail to the petitioner at this stage.

However, trial court is directed to expedite the trial on regular basis so that it may be concluded expeditiously. At the same time, the Superintendent of Police Vaishali is directed to ensure the presence of the witnesses in the court on date fixed of the case.

Accordingly, this application stands dismissed. (Vinod Kumar Sinha, J) sujit/- U T
