JUSTICE SANJAY PRIYA ORAL ORDER 08-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. 177(C) of 2015, corresponding to T.R. No. 5605 of 2015 instituted for the offence under Sections 323 and 498(A) of the Indian Penal Code.
Petitioner is husband of the informant.
The counsel for the opposite party No. 2 has appeared. It has been submitted on behalf of the opposite party No. 2 (Complainant) that she has two daughters and one son, but the petitioner is not maintaining either the complainant or the children.

In such circumstances, from the conduct of the petitioner (husband) it appears that after marriage, he is totally neglecting his wife and children.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
