JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Kotwali P.S. Case No.12 of 2020 registered for the offence punishable under Sections 25(1-b)A, 26, 27 and 35 of the Arms Act and Section 30(a) and 37(II) of the Bihar Prohibition and Excise Act.

The Station House Officer, Kotwali P.S., Gaya, is the informant. It is alleged in the First Information Report that the police learnt about the fact that certain persons were creating unnecessary noise and were hurling abuses and were drunk. Two of them, including the petitioner, were apprehended. According to the police, both of them were drunk. It is further alleged that from the petitioner's possession one live cartridge was recovered. The petitioner is in custody since 11.01.2020.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya, in Kotwali P.S. Case No. 12 of 2020.
