JUSTICE SANJAY PRIYA ORAL ORDER 30-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Naya Ram Nagar P.S. Case No. 181 of 2018 instituted for the offence under Sections 366(A)/34 of the Indian Penal Code.

Counsel for the petitioner submits that victim girl on recovery has given statement under Section 164 Cr. P.C. stating that she has voluntarily gone with Dheeraj Kumar and has performed marriage with him. The victim girl has further stated in her statement recorded under Section 164 Cr. P.C. that she wants to live with Dheeraj Kumar.

In the statement recorded under Section 164 Cr. P.C. the court has assessed the age of victim girl to be 20 years and the victim girl has also stated her age as 20 years.

Petitioner is said to be in custody since 10.08.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Munger, in connection with Naya Ram Nagar P.S.
