Petitioner prays for bail in connection with Patrakar Nagar P.S.Case No. 131 of 2018 registered for the offence punishable under Section 395 of the Indian Penal Code. Allegation as per FIR is that while informant was sleeping in his house, 4-5 accused miscreants came and surrounded the informant and on the point of pistol and dagger they tied his hands and legs and looted away articles, including gold chain, ear rings, cash Rs.60,000/- etc. from his house. Petitioner is not named in the FIR and later on his name transpired during course of investigation and he is accused in three other cases.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him

Patna High Court Cr.Misc. No.64733 of 2018(2) dt.29-10-2018 2/2 and he has not been put on test identification parade and after his arrest he has been remanded in other cases in which he has not been named.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides, as investigation is going on, as such, I am not inclined to grant bail to the petitioner. This petition is disposed of with direction that once charge sheet has been submitted in this case and if it is found that there is no other material against the petitioner except confessional statement of co-accused, he shall be released on bail by the court below to its own satisfaction.
