ANJANA MISHRA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Sabour P.S. Case No.162 of 2018 for allegedly having committed the offence under Sections 147, 149, 323, 427, 436, 307 and 504/506 of the Indian Penal Code, which is pending in the court of the learned A.C.J.M.- X, Bhagalpur.

Learned counsel for the petitioner submits that there was previous dispute between the parties and, therefore, the present case has been lodged making specific allegation against the petitioner. It is further submitted that in view of such facts, the story as against the present

Patna High Court Cr.Misc. No.65985 of 2018(2) dt.19-12-2018 2/2 petitioner and his false implication cannot be ruled out and, therefore, the petitioner may be extended the privilege of pre-arrest bail.

A perusal of the F.I.R. clearly reveals that the petitioner has had a role to play and in view of such facts and circumstances, the prayer for bail cannot be accepted. It is, accordingly, rejected.
