The petitioner is in custody in connection with Madhoaurah P.S. Case No. 496 of 2018 for the offences under Sections 399, 402 of the Indian Penal Code and Section 25(1b)a, 36/35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 20.10.2018. He further submits that in the instant case one country made pistol and one live cartridge were recovered from the possession of the petitioner.

Considering the fact that petitioner has remained in custody for more than five months, the Court is inclined to grant

Patna High Court CR. MISC. No.20249 of 2019(2) dt.02-04-2019 2/2 bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate 8th, Saran at Chapra in connection with Madhoaurah P.S. Case No. 496 of 2018.
