The petitioner, who is in custody since 26.08.2019 and is a person of clean antecedent, seeks bail in connection with Piro P.S. Case No. 229 of 2019 dated 12.08.2019 instituted for the offence under Sections 302, 114, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The informant has alleged that he was talking to his aunt when one person came and fired at her. Later the petitioner and others are also said to have arrived at the place of occurrence and exhorted the aforesaid person who had fired to ensure that the aunt of the informant is killed.

No.18834 of 2020(2) dt.09-06-2020 2/2 There appears to be a dispute with respect to land and the agnates of the deceased are apprehensive that the deceased would otherwise, if not prevented, bequeath her property to her brothers and their families. It has been urged on behalf of the petitioner that he is not alleged to have resorted to firing. Similarly situated accused persons are also stated to have been granted bail by a bench of this Court.

Considering the aforenoted aspect of the matter, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro P.S. Case No. 229 of 2019.
