The petitioner seeks bail in Lalganj P.S. Case No. 338/2018, instituted for the offences under Section 414 of the Indian Penal Code read with Sections 30(a), 32(a) and 41(1) of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that 285.84 litres of foreign liquor has been recovered from a Maruti Van. It is alleged that seeing the police party, petitioner who was sitting on the driver seat started running away but the police apprehended him after chase.
Learned counsel for the petitioner has submitted that petitioner was not driver of the vehicle. He was arrested merely on
Patna High Court Cr.Misc. No.64540 of 2018 (2) dt.29-10-2018 2/2 suspicion. Petitioner is in custody since 21.09.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IInd-cum-Special Judge, Vaishali at Hajipur in connection with Lalganj P.S.
