JUSTICE PARTHA SARTHY ORAL ORDER 02-06-2020 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners have filed the instant application for grant of regular bail in connection with Kochadhaman P.S. Case no. 42 of 2020 registered under section 414 of the Indian Penal Code and section 11 of the Prevention of Cruelty Towards Animal Act, 1960.

As per allegation in the FIR, it is stated that the three petitioners were found driving and transporting large number of animals/cows/cattles on three different pick-up vans in a cruel manner and as such the case was instituted and they were taken into custody.

It is submitted by learned counsel for the petitioners that the allegations as levelled in the FIR are false and concocted. The petitioners are the drivers of the seized vehicle and they have no concern with the alleged cattle.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations, the petitioners having no criminal antecedents and being in custody since 8.2.2020, the Court is inclined to enlarge the petitioners on bail. The petitioners are directed to be enlarged on bail in connection with Kochadhaman P.S. Case no. 42 of 2020 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
