The petitioner seeks bail in a case instituted under Sections 272, 273 of the Indian Penal Code and 47(a) of Bihar Excise Amendment Act, 2016.
Total 200 litres of country made liquor are said to have been recovered from the tempo of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.07.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be the owner of the vehicle, on which, the liquor is said to have
Patna High Court Cr.Misc. No.42206 of 2016 (2) dt.03-10-2016 2/2 been recovered. The petitioner has got no concern with the alleged recovery. He had no knowledge regarding the goods, which was being carried on the said tempo. The said tempo of the petitioner used to run on hire by the driver. There is no compliance of section 100 of the Cr.P.C.
On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati at Gaya, in connection with Sherghati P.S.
