Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 413, 414 and 34 of the Indian Penal Code, registered in connection with Singhia P.S.Case No. 173 of 2019.

It is a case of motor-cycle theft. Co-accused Sunil Kumar was arrested during the course of investigation and on his disclosure one motor-cycle without number plate was recovered from the house of the present petitioner. The

Patna High Court CR. MISC. No.36075 of 2021(5) dt.05-09-2022 2/2 petitioner has one criminal antecedent as mentioned in paragraph no.1 of the anticipatory bail petition. The confessional statement of the said co-accused led to recovery of stolen motor-cycle from the house of the petitioner. In view of aforesaid, it is not a fit case for anticipatory bail. The prayer for anticipatory bail on behalf of the petitioner is hereby rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
