JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Banka P.S. Case No.87 of 2017 registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. In view of direct and specific allegation made against the petitioner in the first information report by the principal of the college that he being a clerk of the college defalcated rupees fifteen lacs and fifty three thousand from the college fund, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the prayer for grant of pre-arrest bail is rejected.
In case the petitioner surrenders and seeks bail, the same
Patna High Court Cr.Misc. No.21887 of 2017 (2) dt.12-07-2017 2/2 shall be considered on its own merits without being prejudiced in any manner by this order.
