JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, on 31.02.2020 at about 2.30 PM when the informant and his two brothers were grazing the cattle at the bank of river of village Hematpur, this petitioner is alleged to assaulted all the three persons as a result of which they sustained injuries.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that FIR has been lodged after delay of three days without any explanation. Petitioner has got clean antecedent. Out of three injured person injury report of Badho

Patna High Court CR. MISC. No.33828 of 2021(3) dt.23-06-2022 2/2 Yadav has been found to be simple in nature whereas injury report of informant and Bihari Yadav were kept reserved. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the nature of accusation and the fact that three persons received sharp cut injury in the occurrence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
