JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2016 Petitioner is permitted to make necessary correction in para-12 of the petition in course of the day. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-B) a, 26 and 35 of the Arms Act. Allegation is that petitioner was apprehended while vehicle checking by police and on search, arms were recovered from his possession.

It has been submitted on behalf of petitioner that he is in custody since 2.9.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that one loaded country made pistol and two cartridges are said to have been recovered from possession of the petitioner. No compliance under Section 100 of the Code of Criminal Procedure is made.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.53465 of 2016 (2) dt.16-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Danapur, Patna, in connection with Dulhin Bazar P.S. Case no. 165 of 2016.
