JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Majorganj P.S. Case No. 378 of 2016 registered under Sections 304-B and 201/34 of the Indian Penal Code.
Regard being had to the accusation made in the first information report that the victim was killed in her matrimonial home within six months of her marriage for non-fulfilment of demand of dowry, I am not inclined to grant pre-arrest bail to petitioner no.1 Ram Kishore Singh @ Raj Kishore Singh and petitioner no.2 Ram Badan Singh, who are uncles-in-law of the
Patna High Court Cr.Misc. No.22278 of 2017 (3) dt.12-07-2017 2/2 deceased.
Accordingly, their prayer for grant of pre-arrest bail is rejected.
So far as petitioners no.3 and 4, namely, Soni Kumari @ Soni Devi wife of Satyendra Singh and Soni Kumari daughter of Binod Singh are concerned, they are married sister-in-law and unmarried sister-in-law respectively and there is no specific allegation against them, the petitioners no. 3 and 4 named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 378 of 2016 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender in the court below within six weeks from today.
