The petitioner seeks regular bail in connection with Murar P. S. Case No. 31 of 2021 (Sessions Trial No. 207 of 2021) registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. As per the prosecution case, the son of the informant was a handicapped person and he was doing mechanic work. The named accused persons also run the same type of shop next to the shop of the informant's son. It
Patna High Court CR. MISC. No. 29006 of 2023(2) dt.24-05-2023 2/3 is further alleged that the son of the informant told the informant that the accused persons threatened to kill him due to some business dispute. When the son of the informant did not return on time, a search was made and in course of search, the dead body of the son of the informant was found in a well.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 10.01.2022.
Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioners. Considering the nature of allegation levelled against the petitioner, his period of custody and his clean antecedent, this application is allowed.
Let the petitioner, above named, be released on bail, after framing of charge if the charge is not framed yet on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge- IV,
