Petitioner, who is in custody, seeks bail in connection with Mufassil P.S. Case No. 220 of 2018 registered for the offences punishable under Sections 399, 402, 307, 353, 414 and 120(B) of the Indian Penal Code and under Section 25(1-b), 26, 35 and 27 of the Arms Act.

Informant has alleged that on a secret information received by him that some criminals have assembled to commit some grave crime, he reached the place of occurrence and out of six one person was arrested, however, five managed to escape. The apprehended one in his confession has named petitioner to be one of the persons who had fled away.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.68712 of 2018(2) dt.30-11-2018 2/2 that he is innocent and has committed no offence. He has falsely been implicated in this case. He was not apprehended on spot. Nothing has been recovered from his possession. He has no criminal antecedent and he is in custody since 30.07.2018. It has been further submitted that similarly placed co-accused has been granted bail by this Court in Cr. Misc. No. 67354 of 2018 and 67363 of 2018 vide order dated 27.11.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Mufassil P.S. Case No. 220 of 2018.
