JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2020 The office has reported that defects, as pointed out, have not been removed as yet but learned counsel of the petitioner submits that he has already taken step for removal of the defects by filing petition through e.mail. However, hard copy of petition filed by the petitioner is not available on the record.

Learned counsel of the petitioner submits that he undertakes to remove the defects when the court starts normal functioning.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is an accused in Nayagaon P.S. Case No. 53 of 2019 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code as well as 27

Patna High Court CR. MISC. No.20571 of 2020(4) dt.21-09-2020 2/2 of the Arms Act.

No doubt, petitioner is named in the first information report but no specific overt-act has been attributed against him and according to prosecution case itself, it was co-accused Rupak Kumar Dipak @ Kare Singh who opened fire on the informant and other.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Nayagaon P.S. Case No. 53 of 2019.

However, petitioner shall remove the defects, as pointed out by the office, within four weeks from the date when the court starts normal functioning and if he fails to do so, the office shall place the record before appropriate Bench for passing necessary order.
