The petitioner seeks bail in Kadamkuan P.S. Case No. 174/2016, corresponding to S.Tr. No. 543/2016, registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and 25(1-B)A, 26 and 35 of the Arms Act. From the possession of the petitioner one loaded country made pistol, one mobile and two cartridges were recovered for that the petitioner is in jail since 23.04.2016. Similarly situated co-accused Rahul Upadhyay @ Rahul Kumar has already been enlarged on bail vide order passed in Cr. Misc. No. 46266/2016. The petitioner has remained in jail for about eight months and he has got no criminal antecedent. Considering the facts aforesaid, the petitioner above
