The petitioner has filed the instant application for grant of bail in connection with Tarapur P.S. Case no. 159 of 2019 registered for offence under section 392 of the Indian Penal Code.

As per allegation in the F.I.R., it is stated by the informant that while he was returning with a bag containing Rs.5 lacs in cash after withdrawing the said amount from the bank, two accused persons came on a motorcycle, snatched the bag and managed to escape with the amount.

It is submitted by learned counsel for the petitioner that he has been falsely implicated in the case merely on suspicion as Rs. 15000/- in cash was found on his person, he has not been

Patna High Court CR. MISC. No.19125 of 2020(2) dt.04-06-2020 2/2 put on T.I. Parade and there is no material whatsoever to connect him with the alleged crime. It is submitted that confessional statement before the police carries no value. The petitioner is in custody since 28.10.2019.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances mentioned above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Tarapur P.S. Case no. 159 of 2019 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, Munger.
