2. The petitioner has prayed for bail in connection with Balua Bazar (Baluwa Bazar) P.S. Case No. 05 of 2026 registered for the offence punishable under Section 69, 108 of the B.N.S., 2023.
3.The case of the prosecution is that the informant was in a relationship with the petitioner. It is alleged that the petitioner established physical relations with the informant on the false promise of marriage. It is further alleged that the informant underwent an abortion on the same promise. It is also alleged that, at some point, the petitioner refused to marry the informant. On 11.01.2026, a panchayat directed the petitioner to
Patna High Court CR. MISC. No.21514 of 2026(2) dt.06-04-2026 2/3 pay Rs. 3,50,000/- and further directed that the informant shall solemnize marriage at some other place.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that from perusal of the FIR itself, it is clear that the informant was in a relationship for the last eight years with the petitioner and she has complained regarding sexual intercourse on the false promise of marriage at such a belated stage. He also submits that it is a case of a live-in relationship and breakup thereafter. Both parties are majors. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 13.01.2026.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief
