JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 19.07.2016 in a compliant case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that that the petitioner admits his marriage with the complainant. Though, the petitioner was granted provisional anticipatory bail by this Court on the submission that he is ready to keep the complainant as wife with full dignity and honour but since he failed to comply the undertaking, hence his bail bonds were cancelled. The petitioner is still ready to keep the complainant as

No.39439 of 2016 (2) dt.09-09-2016 2/2 wife with full dignity and honour, statement to that effect has been made in para 10 of the petition which reads as follows:- "That the petitioner even tried his level best to take back the complainant with full dignity and honour and still desires to live his conjugal life peacefully and happily."

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Complaint Case No. 250C of 2011. (Dinesh Kumar Singh, J) Amrendra/- U T
