2. Heard learned counsel for the petitioner as well as learned APP for the State.

3. In this case, the petitioner is seeking regular bail in connection with Shahkund P.S. Case No. 448 of 2023, registered for the offences punishable under Sections 366(A) of the IPC and Section 8 of the POCSO Act.

4. As per prosecution case, the informant's minor daughter used to talk with Guddu Yadav (the petitioner) through mobile. When informant prohibited his daughter from talking with the petitioner, the petitioner enticed away the minor daughter of the informant.

5. At the very outset, learned counsel for the petitioner

Patna High Court CR. MISC. No.31788 of 2024(7) dt.07-10-2024 2/2 has submitted that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the petitioner is under custody for nearly one year. It has been further submitted that the victim did not support the prosecution case in her statement under Section 164 of the Cr.P.C and the petitioner is a person of clean antecedent.

6. Learned APP for the State has opposed the prayer for bail.

7. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (POCSO)-cum-7th Additional District and Sessions Judge, Bhagalpur in connection with Shahkund P.S. Case No. 448 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
