The petitioner apprehends his arrest in Town (Muzaffarpur) P.S. Case No. 36 of 2017 instituted for the offence under Section (s) 323, 420, 467, 468, 379, 120B, 504 of the Indian Penal Code.

It is alleged in the complaint petition that when the complainant went to plough her land this petitioner told that he has got the land through sale deed executed by her. It is alleged that this petitioner has got the sale deed executed in his favour by impersonating some other lady in place of the complainant. The counsel for the petitioner has annexed Xerox copy of the sale deed executed by the complainant in the

Patna High Court Cr.Misc. No.13964 of 2017 (2) dt.27-03-2017 2/2 year 2010 in favour of the petitioner which bears the photocopy and signature of the complainant in the registry office. Moreover, it appears that sale deed was executed in the year 2010 and on the basis of sale deed the name of the petitioner has also been mutated and rent receipt has also been issued in favour of the petitioner as appears from Annexure-2 series.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Town (Muzaffarpur) P.S. Case No. 36 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
