JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2014 Heard learned counsels for the petitioner and the State. The petitioner has renewed his prayer for anticipatory bail in connection with Tajpur (Halai) P.S. Case No. 114 of 2012 registered for the offences punishable under Sections 148, 149, 323, 307, 379 and 504 of the Indian Penal Code pending in the court of learned CJM, Samastipur.

Earlier anticipatory bail application of the petitioner was rejected by this Court vide order dated 30.09.2013 passed in Cr. Misc. No. 29375 of 2013.

It is submitted by learned counsel for the petitioner that it is an error of record which was recorded in the earlier order that this petitioner caused serious head injury to the victim Nandan Kumar, though, the FIR reflects that the petitioner assaulted Harikrishna Mahto whose injury report has been brought on record

Patna High Court Cr.Misc. No.45511 of 2014 (2) dt.24-12-2014 2/2 as Annexure-5 which suggests the injury superficial, swelling, abrasion simple in nature. It is further submitted that other similarly situated accused persons have been granted bail vide Cr. Misc. No. 29375 of 2013.

This Court finds no reason for the learned court below not to consider the regular bail of the petitioner preferably on the same day if the petitioner surrenders within a period of six weeks. Accordingly, the application is disposed of.
