The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 149, 307, 302, 120B of the Indian Penal Code, section 27 of the Arms Act and sections 16(1)A and 18 of Unlawful Activities (Prevention) Act, 1967.
The prosecution case is that the accused persons came on white Scorpio vehicle and two motorcycles armed with carbine and pistol. The Scorpio vehicle was of coaccused Rakesh Rai.
Co-accused Vikash Rai started indiscriminate firing from carbine on the father of the informant and when the father of the informant tried to escape the

No.37680 of 2015 (2) dt.17-09-2015 2/2 petitioner, who was on motorcycle, pushed him down and resorted to fire from pistol, thereafter Vikash Rai from carbine and Manshi Rai from pistol resorted to fire whereas Jaleshwar Rai, Suman Rai and Amarjeet Rai chased the informant while resorted to fire but the informant did not receive any injury. It is submitted by learned counsel for the petitioner that the victim, the father of the informant, was a veteran criminal who killed the son of the petitioner in 2009 for which Manjhi P.S. Case No. 39 of 2009 was registered as a result the petitioner has been roped in the present case. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Amnour P.S. Case No. 164 of 2014 pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.
With the aforesaid observation, this application is disposed of.
