Petitioner seeks bail in a case registered under Section302 of the Indian Penal Code. Initially, the petitioner lodged the present case levelling allegation against one Abre Alam and three others. In course of investigation, one eye witness namely, Rinku Kumari vide paragraph-10 of the case diary says that she had seen the occurrence and had identified Abre Alam but the police made the petitioner accused only on the basis that he, without giving information, got buried dead body of the deceased.
