The petitioners seek bail in Bakhtiyarpur P. S. Case No. 540 of 2017 instituted for the offence under Section(s) 364A of the Indian Penal Code.
Learned counsel for the petitioners has submitted that petitioners are not named in the written report. The victim boy has not taken the name of these petitioners in his statement recorded u/s 164 Cr.P.C which is annexed as Annexrue-2 to the bail petition. The victim boy has not been recovered from the house of these petitioners. Petitioners have been detained by the police merely on
Patna High Court Cr.Misc. No.62252 of 2018(2) dt.11-10-2018 2/2 suspicion and later on remanded in this case. The victim boy has been recovered from the house of co-accused Vikramaditya Paswan which is apparent from order dated 28.6.2018 passed by coordinate Bench of this Court in Cr. Misc. no. 21294 of 2018 whereby his prayer for bail has been rejected.
Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM, Barh, Patna in connection with Bakhtiyarpur P. S. Case No. 540 of 2017 subject to the condition that both the bailers shall be the close relative of the petitioners.
