JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-12-2023 From the supplementary show cause reply which has been filed on behalf of the Nalanda Open University, it transpires that an L.P.A. has been preferred against this Court's order dated 02.11.2021 passed in CWJC No. 692 of 2020, violation of which has been alleged in the present contempt application.

2. Learned counsel for the petitioner has submitted that in the said L.P.A., an interim order was passed on 08.09.2023, but only for one month from the said date.

3. Be that as it may, considering the circumstance that the opposite parties have preferred an appeal in which an

Patna High Court MJC No.593 of 2022(6) dt.01-12-2023 2/2 interim order has been passed, I am not inclined to proceed with the present contempt application as the violation of this Court's order cannot be said to be deliberate.

4. This application is accordingly disposed of with an observation that the petitioner shall be at liberty to take steps in accordance with law depending upon the outcome of the L.P.A. No. 1034 of 2023.
