JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 420, 467, 468, 469, 471 and 120B of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he is Branch Manager of the UCO Bank at Chapra Branch. Only allegation against the petitioner is that from the informant's account at Chapra Branch Rs. 9,70,000/- was found shortage and on enquiry it appears that on the basis of a cheque issued in the name of co-accused Manoj Kumar Yadav, the aforesaid amount has been transferred to his account at UCO Bank, Ekma Branch. Now Branch Manager, UCO Bank, Ekma Branch, had also lodged

Patna High Court Cr.Misc. No.8147 of 2017 (2) dt.27-02-2017 2/2 a case against aforesaid Manoj Yadav and investigation in that case is on and petitioner has nothing to do with withdrawal of amount. He has been made accused in this case as he is Branch Manager.

Having heard both sides, considering the aforesaid facts, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case no. 552 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required.
