JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Salkhua P.S. Case No. 77 of 2011 for the offences instituted under Sections 420, 467, 468, 120(B), 323, 354 and 504/34 of the IPC.
The prosecution story, in brief, is that the informant has land having Khata No. 498, Kheshra No. 4303, Area 2 Katha through Deed No. 16551 dated 15.12.2005 and also land having Khata No. 298, Khesra No. 4303 area 2-1/2 Katha through Deed No. 16550 dated 15.12.2005 and the accused persons forcefully taken possession of the land for construction of the building of Kasturba Madhya Vidyalaya and when the informant went there to
Patna High Court Cr.Misc. No.39534 of 2015 (2) dt.29-09-2015 2/2 make objection then accused persons abused her and the land was by forcibly taken by the accused persons for construction of building of Kasturba Madhya Vidyalaya.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. The matter is of civil nature. Other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 5432/2013, 6010/2013 and 25231/2013.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Salkhua P.S. Case No. 77/2011 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
