JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A, 26 of the Arms Act. One country made pistol and live cartridge are said to have been recovered from conscious possession of the petitioner and apart from this, 25 live cartridges were recovered from the dickky of motorcycle and similarly, firearms and cartridges were recovered from conscious possession of co-accused. Submission on behalf of the petitioner is that the cousin brother of the petitioner was contesting election and the opponent of his cousin brother got implicated the petitioner in the present case. Patna High Court Cr.Misc. No.47194 of 2016 (2) dt.28-10-2016 2/2 disclosed that the arms and cartridges belonged to one Ram Ekbal Rai, who had given the said arms and ammunitions to them. Moreover, petitioner is in jail custody since 19.05.2016 and the investigation against him appears to have already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Neeraj Kumar, Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S.
