The petitioner apprehends his arrest in Noorsarai P.S. Case No. 247 of 2016 registered for the offences punishable under Sections 379, 354B and other Sections of the Indian Penal Code. The informant alleged that the petitioner and others came to her house and enquired about her son and husband. The informant replied that her husband and son were not in the house but, in the meantime her son Sanoj Kumar came. All the accused persons assaulted him. When the informant and her daughter went to save, Baleshwar Yadav torn her clothes, assaulted her and snatched chain made of gold.

Learned counsel for the petitioner submits that the petitioner is next door neighbour of the informant. Some

Patna High Court Cr.Misc. No.18879 of 2017 (2) dt.18-05-2017 2/2 altercation took place between the informant and Baleshwar Yadav and that is why the petitioner who is relative of Baleshwar Yadav has also been implicated in the case. No specific allegation is made against the petitioner.

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Nalanda in Noorsarai P.S. Case No. 247 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
